Byrider TV Sweepstakes

THIS BYRIDER SWEEPSTAKES (“SWEEPSTAKES”) IS BEING SPONSORED AND CONDUCTED BY BYRIDER ADVERTISING GROUP, INC.(“SPONSOR”) AND NOT BY BYRIDER SYSTEMS, INC., YOUR LOCAL BYRIDER PARTICIPATING DEALERSHIP OR ANY OTHER PARTY. NOT ALL BYRIDER DEALERSHIPS ARE PARTICIPATING. SEE BELOW FOR DETAILS.

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PURCHASE OF A VEHICLE OR MAKING A PAYMENT ON AN EXISTING BYRIDER CONTRACT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR REGULATION.

WHEN YOU ENTER YOU ARE UNCONDITIONALLY AGREEING TO ACCEPT AND BE BOUND BY THESE OFFICIAL RULES AND THAT ALL DETERMINATIONS OF THE SPONSOR ARE FINAL AND BINDING. SPONSOR MAY BE REFERRED TO AS “BYRIDER”, “Sponsor”, “WE”, “OUR” OR “US” IN THESE OFFICIAL RULES.

1. Entry Period: When the Byrider dealership listed at byrider.com/related/tv-sweepstakes (each, a “Participating Dealer”) opens for business on November 22, 2021 and after that, any time a Participating Dealer is open, up until 7:00 p.m. EST, 6:00 p.m. CST, 5:00 p.m. MST and 4:00 p.m. PST on November 28, 2021 (“Entry Period”) you can go to a Participating Deal and enter the Sweepstakes. Even though a Participating Dealer may remain open later that day, your entry must be received by the times above or it will not be included and be ineligible to participate or win.
2. Eligibility: You must be (i) a legal resident of the 50 United States (but not New York, Florida or Rhode Island) or the District of Columbia ; and (ii) at least 18 years of age or otherwise considered an adult in the jurisdiction in which you live. Employees, shareholders, directors, officers, agents, advertising and promotional agencies, suppliers and licensees of Sponsor, Sponsor’s parent, subsidiaries and affiliates (including CNAC) and/or any Byrider franchisee or dealership and,  members of their immediate families or persons living in the same household are not eligible to enter or win (individually and collectively, the “Byrider Entities”).
3. To Enter: During the Entry Period, go to a Participating Dealership and simply fill out the entry form by printing your name, mailing address, including zip code, phone number and email address where we may contact you and  placing it in the Sweepstakes drawing box located in each Participating Dealership. You are responsible for ensuring your completed entry form is deposited in the Sweepstakes box at your Participating Dealership.

LIMIT: One entry per person, regardless of method of entry. Odds of winning a prize at a Participating Dealership depend on the total number of eligible entries received at that Participating Dealership. Illegible or incomplete entries are void.

4. Drawing; Prizes: On or about November 30, 2021 a representative of the Sponsor will draw the potential winner by random drawing from among all eligible entries received at each Participating Dealership. AN ENTRANT WILL NOT BE DECLARED A WINNER UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND COMPLIANCE WITH ALL THE TERMS OF THESE OFFICIAL RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. The Sponsor or representative of the Participating Dealership will notify the potential winner by phone, mailing a notification and, if provided, sending an email to the email account address provided at the time of entry. We are not responsible for any late, lost or misdirected notification and if, for any reason within five (d) days after we send you a notice, we cannot reach you or you do not respond, we have the right to disqualify your entry and may select another potential winner at random from the remaining eligible entries, in our sole discretion.

There will be one (1) winner drawn from the eligible entries submitted at each of the Participating Dealerships, for a total of thirty two (32) Flat Screen Televisions each valued at approximately $300 each, although the particular brand may differ. The total approximate retail value of all the prizes in the Sweepstakes is $11,600.  If a prize cannot be awarded for any reason, through no fault of winner, Sponsor reserves the right to substitute the prize with another prize of equal or greater value, as determined by Sponsor in its sole discretion.

All federal, state and local taxes on prize value are the sole responsibility of the winner. Prizes are non-transferable. TO THE FULLEST EXTENT PERMITTED BY LAW, SPONSOR DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES IN CONNECTION WITH THIS SWEEPSTAKES AND ANY PRIZE, INCLUDING, WITHOUT LIMITATION, THAT YOU WILL BE ABLE TO USE OR KNOW HOW TO USE ANY PRIZE. EACH PRIZE IS AWARDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED.

5. Release: By entering you are agreeing to release and hold harmless Sponsor, and each of the Byrider Entities (the “Released Parties”), harmless from all claims, losses and damages resulting from your entry and/or participation in the Sweepstakes and your acceptance, possession and use or misuse of any prize, including, but not limited to, any claims based on any personal injury, property damages or loss, death or use of the your name, likeness, voice and/or biographical information as permitted hereunder. Except to the extent prohibited by law or regulation, you agree to allow Sponsor to arrange to photograph or otherwise record you, your image and use your first name and the state where you live, referring to you in the context of this Sweepstakes, in advertising, marketing and promotional material without notice, compensation or consideration of any kind and these rights includes Sponsor, Participating Dealerships and any other Byrider dealership, whether company-owned or franchisee and their respective advertising and promotional agencies. We may require you to sign a release form, releasing the Released Parties from liability and acknowledging your waiver of any rights of publicity or other rights associated with the Sponsor’s exercise of its rights.
6. General: We may disqualify and declare your entry ineligible you if you fail to comply with these Official Rules or if we believe you have or are tampering, interfering with or disrupting any entries or the operation of the Sweepstakes, including, without limitation, submitting more than one entry form. Sponsor reserves the right in its sole discretion to cancel, terminate, suspend, modify or extend the Sweepstakes (or any part thereof) for any reason or no reason, as determined by Sponsor in its sole discretion. In case of early termination, Sponsor will have the right to choose the winner from the eligible entries received prior to termination. If we delay or fail to enforce our rights that doesn’t mean we waive them. Neither the Sponsor nor any of the Released Parties are responsible for any typographical or other error in the printing of the offer, or Official Rules, the administration of the Sweepstakes, the selection of potential winners and winners, or in the announcement of the prize. In no event will  more than the stated number of prizes be awarded. Except where prohibited by law, all entrants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded and the interpretation of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively by the courts located in Indianapolis, in the State of Indiana applying Indiana law, without reference to any conflicts of law principles; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees, in the aggregate not to exceed $300; and (c) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, direct, compensatory, indirect, punitive, incidental, special, exemplary or consequential damages or any other damages, other than for actual out-of-pocket expenses to the limits set forth above, and expressly waives any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

8. Winners List: You may request the names of the winners after the prizes are awarded by writing us at the address below with the words “Byrider TV Winner’s List” on the outside envelope and enclosing a self-addressed, postage prepaid envelope.
